Terms of service

These are the terms for the website subscription service provided by Burton Web Design, a trading name of MarkD Limited (“we”, “us”). Written in plain English on purpose.

The service

We design, build, host and maintain a website for your business, with unlimited content updates under our fair use policy, in exchange for a monthly fee paid by Direct Debit. Work starts once your first payment is collected. There is no setup fee.

Payment

• Fees are billed monthly in advance by Direct Debit through GoCardless, plus VAT.
• If a payment fails we'll let you know by email and retry; the site stays live during a reasonable grace period.

Cancellation

• Cancel any time by email with 30 days' notice. No exit fees.
• If you cancel in your first 30 days and we haven't launched, we'll refund your first month.
• On cancellation we transfer your domain to you and provide an export of your content.

Ownership

• Your domain name is registered in your name and is always yours.
• Content you supply remains yours.
• The design and code we create transfers to you after 12 months of subscription, or earlier by agreement.
• Ownership transfer doesn't include the ongoing service. Hosting, SSL, security, backups and content updates are provided by the monthly subscription and end when it ends — if you take the site elsewhere, you'll need to arrange your own hosting and maintenance. We'll provide a full export and reasonable help with the move.

Our responsibilities

We keep your site hosted, secure and backed up, and make content updates within the published timescales. If something breaks, fixing it is on us, not you.

Liability

Our total liability under this agreement is limited to the fees you've paid us in the previous 12 months. Nothing in these terms limits liability that cannot be limited under English law. These terms are governed by the law of England and Wales.
